Frequently Asked Questions

A Revocable Living Trust is a legal document that holds your assets and specifies how they will be distributed after your death. It can be changed or revoked at any time during your lifetime, offering flexibility. The trust allows assets to bypass the probate process, saving time and reducing costs. It also maintains privacy since it does not become public record like a will. Additionally, a revocable living trust ensures that if you become incapacitated, a successor trustee can manage your assets without court intervention. This tool provides control over how and when assets are distributed to beneficiaries, offering a more efficient and personalized estate plan.

A Durable Power of Attorney (DPOA) is a legal document that allows you to appoint someone to manage your financial and legal matters if you become incapacitated. Unlike a regular power of attorney, a durable power of attorney remains in effect even if you are unable to make decisions for yourself, ensuring your affairs are handled without the need for a court-appointed guardian.

By having a DPOA, you can designate a trusted individual to act on your behalf, making it easier to manage financial and legal decisions during times when you may not be able to do so yourself. This prevents delays and potential legal complications, providing peace of mind that your interests will be protected.

An Advance Health Care Directive (AHCD) is a legal document that outlines your medical preferences and designates someone to make healthcare decisions on your behalf if you become unable to communicate them yourself. It typically includes instructions for medical treatments, life-sustaining measures, and organ donation, along with the designation of a health care agent to carry out your wishes.

Having an AHCD ensures that your healthcare preferences are respected and that a trusted person is authorized to make decisions in line with your values, avoiding confusion or disagreements among family members. It provides peace of mind, knowing your wishes will be followed in critical situations when you cannot speak for yourself.

A HIPAA Release is a legal document that allows you to authorize the release of your medical information to specific individuals or entities, such as family members or healthcare providers. It waives the confidentiality protections under the Health Insurance Portability and Accountability Act (HIPAA), enabling your designated representatives to access your health records.

Having a HIPAA Release ensures that your trusted individuals can make informed decisions on your behalf in case of an emergency or if you become incapacitated. It streamlines communication between healthcare providers and your designated contacts, providing smoother care and avoiding delays in critical situations.
